In accordance with the provision of Chapter 31, Division 2 of the Franklin Municipal Code, notice is hereby given that the City of Franklin will hold a Public Hearing on Monday, January 23, 2012 at 6:07 p.m. in the Council Chambers, Franklin City Hall concerning Resolutions #06-12 and  #07-12 authorizing the City Manager to file an application for the State of New Hampshire Drinking Water State Revolving Fund (DWSRF) Program and authorizing Mayor, City Council, and City Manager to borrow up to $3,030,000 from the State of New Hampshire Drinking Water State Revolving Loan Fund (DWSRF) for the Salisbury Road/North Main Street Water Storage Tank(s) Replacement Project.

NOTICE OF PUBLIC HEARING & MEETING

 

In accordance with the provision of Chapter 31, Division 2 of the Franklin Municipal Code, notice is hereby given that the City of Franklin will hold a Public Hearing on Monday, January 23, 2012 at 6:05 p.m. in the Council Chambers, Franklin City Hall concerning Resolution #08-12 a supplemental appropriation in an amount not to exceed $238,957 for the Tiny Twisters Child Care Community Development Block Grant.

Public Hearings Notice

Community Development Block Grant Project

 

The Franklin City Council will hold two consecutive Public Hearings on January 23, 2012, 6:00 p.m. at City Hall, 316 Central Street, Franklin, New Hampshire 03235.  Community Development Block Grant funds are available to municipalities through the NH Community Development Finance Authority. Up to $500,000 annually is available on a competitive basis for economic development, public facility and housing projects, and up to $350,000 for emergency activities. Up to $12,000 is available for feasibility study grants. All projects must directly benefit a majority of low and moderate income persons.  The public hearings will hear public comment on the following:

 

1. A proposed  application to the Community Development Finance Authority for up $350,000 in Community Development Block Grant funds.  The City will retain up to $25,000 for administrative costs.  The remaining funds, up to $325,000, will be subgranted to Headstart for renovations to the Bessie Rowell School where they will be relocating to.  Headstart serves primarily low and moderate income households.

 

2. and, the Residential Anti-displacement and Relocation Assistance Plans.

 

Provisions for persons with special needs can be made by contacting the City Manager’s Office, via telephone or mail, at least five days prior to the public hearing.

TEMPORARY PARKING BAN

 

The City of Franklin will begin downtown transportation improvement construction on

August 15, 2011.

 

This will include the Canal Street municipal parking lot.

 

Therefore, this parking lot will have to be kept clear for construction vehicles and materials. All parking will be moved temporarily to the Church Street municipal lot adjacent to the Franklin Police Department and Franklin District Court.

 

All vehicles must be moved by 6:00 A.M. on August 15, 2011.

 

Failure to do so may result in the ticketing and towing of vehicles, trailers, etc. at the owners expense.

FOR EXECUTIVE COUNCIL DISTRICT TWO

October 20, 2010 Manchester, NH  - Listed below are some of the items that were approved at the Governor and Council Meeting, October 20, 2010, that might be of interest to District Two constituents.

 

The next scheduled Governor and Executive Council Meeting will be held in Concord, New Hampshire on Wednesday, November 17, 2010.

 

GOVERNOR’S COMMISSION ON DISABILITY

 

Authorized to establish the entrance salary for the new Executive Director, John Richards, at Unclassified Salary Grade EE, Step 4, $74,596 annually.  Effective November 1, 2010.

 

DEPARTMENT OF ADMINISTRATIVE SERVICES

 

Authorized to accept and place on file the Report and Findings of Councilor John D. Shea with regard to the refinancing of certain existing indebtedness and the funding of certain capital improvements in connection with Crotched Mountain Rehabilitation Center Inc., Greenfield, NH.  The Center expects to issue approximately $35 million in bonds.

 

Authorized that $160,968,817 be lapsed from the Working Capital Warrant for the month of September.  (2) Further authorized a Working Capital Warrant in the amount of $400,000,000 to cover the expenditures for the month of November.

 

Authorized the State Suggestion and Extraordinary Service Award Evaluation Committee to award a net sum of $1,000 to Chad Hayes of the Department of Transportation for researching and trying a different snow plow blade..  Effective upon G&C approval.  After experiencing poor performance from carbide edges of the plow trucks in District 6, Mr. Hayes sought out a better product.  The JOMA 12” sectional plow edge conformed to the shape of the roadways helping to further clean the roadway of snow and slush.

 

STATE TREASURY

 

Authorized to issue up to $90 million of federal highway grant anticipation bonds, 2010 series.  (2) Further authorized the Trust Agreement and First Supplemental Trust Agreement between the State of NH and Bank of NY Mellon Trust Company, N.A.  (3) Further authorized the bond purchase contract between the State and a syndicate of underwriters.  For the widening of Interstate 93 from Salem, NH to Manchester, NH.

 

DEPARTMENT OF RESOURCES AND ECONOMIC DEVELOPMENT

 

Authorized the Division of Travel and Tourism Development to award grants to the organizations as detailed in letter dated September 21, 2010, totaling $257,584.41 for their 2010/2011 in-state and out-of-state marketing projects under the Joint Promotional Program.  Effective upon G&C approval.  100% General Funds. 

 

DEPARTMENT OF ENVIRONMENTAL SERVICES

 

Authorized to amend a sole source contract with Camp, Dresser & McKee, Inc., Manchester, NH, (previously amended by G&C on 10-21-09, item, #36), for professional engineering services associated with UV Disinfection, Plant Water and SCADA Improvements at the Franklin wastewater treatment plant, by increasing the contract by $955,000 from $1,971,000 to $2,926,000, and by extending the completion date from June 30, 2011 to June 30, 2012.  100% Capital (SRF Loan) Funds. 

 

Authorized to amend a sole source agreement with Homestead Woolen Mills Inc., (previously amended by G&C on 7-28-10, item #29), for dam deconstruction, debris removal, engineering oversight of the removal and river restoration, and cultural resource monitoring associated with the removal of the Homestead Woolen Mills Dam, by increasing the amount by $160,000 from $550,837.96 to $710,837.96.  Effective upon G&C approval.  93.75% Federal, 6.25% Other (Private Contributions) Funds. 

 

DEPARTMENT OF HEALTH AND HUMAN SERVICES

Bureau of Drug and Alcohol Services

 

Authorized to enter into a retroactive agreement with Avis Goodwin Community Health Center, Dover, NH, to provide substance abuse prevention services in Region F in an amount not to exceed $248,352.  Effective October 1, 2010 through June 30, 2012.  53% Federal, 47% General Funds. 

 

Authorized to enter into a retroactive agreement with Health First Family Care Center, Franklin, NH, to provide substance abuse prevention services in Region B in an amount not to exceed $261,930.  Effective October 1, 2010 through June 30, 2012.  50% Federal, 50% General Funds. 

 

Authorized to enter into a retroactive agreement with the County of Sullivan, NH, to provide substance abuse prevention services in Region D in an amount not to exceed $185,869.  Effective October 1, 2010 through June 30, 2012.  71% Federal, 29% General Funds. 

 

Authorized to enter into a retroactive agreement with Cheshire County, Keene, NH, to provide substance abuse prevention services in Region G in an amount not to exceed $302,765.  Effective October 1, 2010 through June 30, 2012.  43% Federal, 57% General Funds. 

 

Authorized to enter into a retroactive agreement with Granite United Way, Concord, NH, to provide substance abuse prevention services in Region E in an amount not to exceed $307,683.  Effective October 1, 2010 through June 30, 2012.  43% Federal, 57% General Funds. 

 

NEW HAMPSHIRE POSTSECONDARY EDUCATION COMMISSION

 

Authorized to enter into a sole source contract with NH College and University Council, Concord, NH, to promote student participation in a rigorous high school curriculum; enhance the quality and number of tools available for school that encourage postsecondary education; expand professional development opportunities for middle and high school guidance personnel regarding academic rigor; and, increase the access to higher education opportunities, build financial literacy, and provide information about the road to college to underrepresented students, in the amount of $250,000.  Effective upon G&C approval through August 14, 2012.  100% Federal Funds. 

 

Authorized to enter into a sole source contract with Campus Compact of NH, Concord, NH, to implement a professional development opportunity for guidance counselors at middle and secondary schools, and financial aid administrators and college admission counselors at institutions of higher education to improve such individuals capacity to assist students and parents to provide information on financing options and to implement a professional development/networking opportunity for these professionals to explore current resources and emerging trends related to higher education access, in the amount of $117,100.  Effective upon G&C approval through August 14, 2012.  100% Federal Funds.  Campus Compact of New Hampshire in the amount of $117,100.

 

DEPARTMENT OF SAFETY

 

Authorized the Division of State Police to modify the existing fleet, by purchasing a LENCO Bear Armored Vehicle to be used as a rescue vehicle, at the state, county and local level.  Effective upon G&C approval.

 

Authorized the Division of State Police to accept and expend an additional $4,914 of federal funds from the NH Highway Safety Agency entitled DWI Patrols for the purpose of combating the DWI problem statewide.  Effective upon G&C approval through June 30, 2011.  100% Agency Income Funds.  Would not having liquor enforcement use marked vehicles help prevent DWI’s?

 

DEPARTMENT OF TRANSPORTATION

 

Authorized the Bureau of Planning and Community Assistance to enter into agreements with the sub-recipients as detailed in letter dated September 15, 2010, to provide funding and services under the Federal Safe Routes to School Program through a local project administration process to create travel plans for schools in Henniker, Nashua, and Manchester, for a total of $36,275.  Effective upon G&C approval through June 30, 2011.  100% Federal Funds.  Henniker, NH will receive $13,000.

WINTER REMINDER TO PROPERTY OWNERS

 

Winter Parking Ban

§ 284-12. Parking; prohibited practices.

A.   No vehicle shall be parked on a public street to remain continuously so parked during the period from 12:00 midnight to sunrise, except in case of emergency, and any vehicle so parked during the period from 12:00 midnight to sunrise shall, at the discretion of the Police Department, be towed away at the expense of the owner of said vehicle.

B.    No vehicle shall be parked on a public street between the hours of 9:00 p.m. and 6:30 a.m. during snowstorms, during snowplowing operations by the city or its agents or during snow removal operations by the city or its agents. In addition to the penalties provided by this article, any vehicle found parked contrary to the provisions of this subsection shall, at the discretion of the Police Department or Municipal Services Department, be towed away at the expense of the owner of said vehicle. [Amended 9-14-1998 by Ord. No. 98-4]

C. No person owning or operating any type of motor vehicle or carriage or having in his or her charge any motor vehicle or carriage shall cause or allow said vehicle to remain standing or parked within the limits of any street in the city in such a manner that said vehicle will interfere with or impede the plowing of snow from the surface of said street, and so-called all-night parking on any street in the city is hereby prohibited during the months of January, February, March, April, November and December.

D. No person owning or operating any type of motor vehicle or other vehicle or having in his or her charge any vehicle shall cause or allow said vehicle to remain standing or parked within the limits of any public parking area in the city, excepting a certain area as designated by signs erected from time to time by the Police Department permitting overnight parking in said posted area between the hours of 11:00 p.m. and 8:00 a.m., in such manner that said vehicle will interfere with or impede the plowing of snow from the surface of said parking area between the hours of 11:00 p.m. and 6:00 a.m. during the months of January, February, March, November and December.

Editor's Note: Original Section 5.05, which immediately followed this subsection and provided for two-hour parking on portions of Central Street, Franklin Street and Memorial Street, was deleted 9-14-1998 by Ord. No. 98-4. See now § 284-23. [Amended 9-14-1998 by Ord. No. 98-4]

E.  Any vehicle parked in violation of the provisions of this section may be towed away by the city or its agents to a suitable location and held there until the reasonable cost of said removal shall have been paid to the city, as well as a storage charge, if said vehicle shall not be reclaimed within 24 hours of its removal. These charges shall be in addition to any fine imposed for violation of this Code.

F. Unless they are inconsistent with the previous regulations, all state statutes with reference to the operation and parking of motor vehicles are hereby deemed in full force in the city. Where appropriate, the doctrine of state preemption shall apply. In cases where two standards are promulgated, the higher shall be deemed to apply.

 

 

 

FROM THE GOVERNOR’S COMMISSION ON DISABILITY PARKING

 

 COMMITTEE

 

 

It is illegal to pile snow into an accessible parking space or access aisle.

 

Accessible parking spaces and access aisles must be cleared within 24 hours of an adverse weather event.

 

Signs designating accessible parking spaces and access aisles that are relocated for the purpose of snow removal must be immediately returned after the weather event.

 

The route of travel from the accessible parking to the accessible building entrance must be kept clear of snow and ice.

 

Obstruction of an access aisle or parking place reserved for persons with a walking disability carries a fine of up to $250. (RSA 265:74-a)
